Insurance Disputes

Insurance Disputes

An insurance company has many duties to its policyholders. Among these obligations are a duty to defend a claim (or lawsuit) even if some or most of the lawsuit is not covered by the insurance policy, and a duty to pay a judgment against the policyholder, up to the limit of coverage, but only if the judgment is for a covered act or omission. As a result, most insurance companies exercise a great deal of control over litigation.

Insurance disputes are often referred to as ’bad faith’ on the part of the insurance company. Examples of bad faith include undue delay in handling claims, inadequate investigation, refusal to defend a lawsuit, threats against an insured, refusing to make a reasonable settlement offer, or making unreasonable interpretations of an insurance policy.

A capable, experienced Abel Law Firm attorney can help you determine if you have been a victim of bad faith or if any damages have been inflicted.

For example, it must be determined that the policyholder has been damaged by an insurance company that refuses to make a reasonable settlement offer which the policyholder feels is due. Likewise, if the policyholder is later subject to a judgment in excess of the policy limits, then damages have occurred and a legal recourse is needed. To determine if damages have occurred and what the appropriate legal proceedings might be, contact the Abel Law Firm today.
